Terms and Conditions

These Terms & Conditions will refer to anyone using our site, services or purchasing product as “you” within this document.

By using or purchasing anything on taylorraebouquet.com, you represent that you have read and agree to all terms and conditions within this document. By using our site, voluntarily sharing personal information, indicating your agreement by following any instructions we place on the Site (such as buttons labeled ”I Agree”), you immediately agree to all these terms and conditions. If there comes a time where you do not agree to any portion from these Terms and Conditions, you must immediately stop using our site and cancel any purchases.

Please read ALL the terms and conditions carefully. When using any portion of this site you acknowledge and represent that you one, have read these terms, two, understand them, three, agree to follow them and four, are 18 years or older. If at any point you do not agree with any portion of this document, we are unwilling and unable to offer our site and services.

(I) The Addition of Flowers Memoir

A. Subscribing with Email

In order to receive consistent *reminders (*which is up to Owner’s discretion), a legitimate email and a recognizable name must be registered. When this particular information is given, you automatically represent that one, all required information you submit is truthful and accurate and two, you will make any necessary changes if such information changes. You are entirely responsible for maintaining the confidentiality as seen fit of your email and name. You agree to notify Taylor Rae Bouquet of any unauthorized use or suspected unauthorized use of your personal information within one month of unwanted occurrence. Taylor Rae Bouquet is not and will not be responsible or liable for any loss or damage that may occur if there is failure to follow the above requirements.

B. Ownership of and Sharing Intellectual Property

Taylor Rae Bouquet retains all rights, title and interest in and to the website, services offered and intellectual property (other than the User information and content). All noted Photographers, Vendors, Suppliers, etc. also reserve the rights, title and interest to their intellectual property within this site. Unless a requested written consent is obtained, you may not, under any circumstance, copy, distribute, publicly display as your own work or create derivative works of any portion within taylorraebouquet.com and paired social media accounts (Facebook and Instagram). Proper sharing of work is allowed: Taylor Rae Bouquet (and/or other Creatives involved) must be given full credit in a public and noticeable way.

(II) Subscription Service

A. Ownership of and Sharing Intellectual Property

Refer to Section (I)B.

B. Email

If you elect to receive emails at any point during the Subscription Service process, you are providing written consent to receive informational, marketing and/or promotional emails from Taylor Rae Bouquet. These emails may include, but are not limited to: Subscription Service delivery reminders, payment reminders, order information, discount codes and promotional material. Refer to (1)A for further terms.

C. SMS Text Messages

If you elect to receive text messages at any point during the Subscription Service process, you are providing written consent to receive informational, marketing and/or promotional SMS text messages from Taylor Rae Bouquet. These text messages may include, but are not limited to: Subscription Service delivery reminders, payment reminders, order information, discount codes and promotional material. You can opt out of receiving these text messages at about point by replying “STOP” to a text message you receive from Taylor Rae Bouquet. By agreeing to receive these SMS text messages, you are automatically responsible for any charges made from your current phone plan. Taylor Rae Bouquet is not and will not be responsible for any extra fees that may occur when agreeing to this service.

D. Payment

For each Flower Subscription Service ordered, you agree to pay the full price for the Product, any applicable taxes and delivery fees at the time you submit the form. All payments are non refundable (refer to (II)H for exceptions). As per the nature of a subscription service, you will be charged monthly through the entire duration of your agreed upon subscription. Refer to (II)H for cancellation terms. You will immediately be billed for the first month of your subscription service. Taylor Rae Bouquet agrees to send an invoice via email and a reminder SMS text message (IF phone number is given) each month during your subscription service. This invoice will be sent within your initial choice of payment (i.e PayPal or Venmo) two weeks prior to the delivery date. If the invoice is not paid in full within 3 days of receiving the notice, a final reminder email and/or SMS text message (IF phone number is given) may be sent to you. If invoice is not paid in full within 7 days of the original notice the subscription service will be terminated and you will receive no further product. You will still be responsible to pay for your monthly subscription until you properly cancel your subscription.

E. Pricing

Any products and/or services, their descriptions, and their prices are subject to change. Taylor Rae Bouquet reserves the right, at any time, to alter, suspend or discontinue the products and services posted on the website. Once you pay for your product and/or service, however, Taylor Rae Bouquet agrees to honor the price and will provide the purchase product and/or service (and if not available will provide comparable product and/or service).

F. Delivery

At this time, Taylor Rae Bouquet may delivery only to the following counties within the state of Utah: Davis County, Salt Lake County and Utah County. Delivery of flower arrangement within the Taylor Rae Bouquet subscription service is anticipated to be made every week between 2:00 and 7:00 PM MST on Tuesdays and Wednesdays. Taylor Rae Bouquet reserves the right to plan out and decide when deliveries will be made to each customer within those parameters. Despite these planned delivery times sometimes there will be delivery challenges outside the control of Taylor Rae Bouquet. Accordingly, you acknowledge that Taylor Rae Bouquet cannot be held liable for any delay in delivery. Taylor Rae Bouquet has the right to change and alter these delivery days at any time. Taylor Rae Bouquet will inform Customer if any changes are made as soon as possible and will agree to abide by the original agreed upon delivery date and time if it is within 7 days of original delivery date and time. If it is outside of the 7 day limit, Taylor Rae Bouquet has the right to deliver the flower arrangement at a new designated date and time.

We STRONGLY encourage someone to be physically present when the flowers are delivered to ensure that each arrangement is properly cared for. Taylor Rae Bouquet will leave flower goods on door steps if no one is present. If the temperature is below 35 degrees Fahrenheit, Taylor Rae Bouquet will attempt to leave the arrangement with a neighbor. IF the flowers have been left on the doorstep or with a neighbor, Taylor Rae Bouquet will inform the customer via email and/or text message within one hour of initial delivery. Once the arrangement is in the customer’s hands, Taylor Rae Bouquet is no longer liable or responsible for the product. If any damages are made after the product leaves the owner of Taylor Rae Bouquet or deliverer’s hand, the product becomes the sole responsibility of the customer.

G. Damages

Due to Taylor Rae Bouquet’s delivery plan (above section), an arrangement is unlikely to be damaged due to sitting out on a front porch (or similar). If for some unseen circumstance such as a car accident to the delivery driver, etc. and the flower arrangement is damaged before delivery, Taylor Rae Bouquet will create an entirely new piece within a time frame discussed between you and Taylor Rae Bouquet.

Once the arrangement is in the customer’s hands, Taylor Rae Bouquet is no longer liable or responsible for the product. If any damages are made after the product leaves the owner of Taylor Rae Bouquet or deliverer’s hand, the product becomes the sole responsibility of the customer.

H. Returns, Refunds and Cancellations

Due to the nature of fresh floral goods absolutely no returns will be accepted.

A cancellation of a subscription service can be made anytime before 7 days of scheduled delivery day for a full refund. If the cancellation is made before the 7 days then the subscription service is terminated, no further invoices will be sent to the customer and full refund will be made if the to-be-delivered arrangement has already been paid for. Customers will not receive a refund for any arrangement they have already received. If a cancellation is made less than 7 days from the expected delivery date, the customer agrees to still pay full price for the product and/or service and understands that no arrangement will be delivered.

I. Promo Codes and Discounts

Taylor Rae Bouquet may offer promo codes to receive discounts on products and services. The Company has the right to refuse offering these discounts or applying these discounts for a Customer for any reasons such as, but not limited to: fraud, actual or expected financial issues, etc.
